Refund policy
Introduction At Devesh Mishra Legal Associate, we are committed to providing excellent legal services in a professional and transparent manner. This Refund & Cancellation Policy outlines the terms and conditions related to the cancellation of services and refunds in compliance with the guidelines set forth by the Advocate Act and applicable legal standards.
1. Legal Services Provided
We provide legal advice, representation, and other legal services as agreed upon between our firm and the client. Our fees are determined based on the nature and complexity of the services rendered, and we ensure full transparency about the charges before commencing any work.
2. Cancellation of Services
Clients may request the cancellation of legal services at any time before the commencement of work or during the course of legal proceedings. However, the cancellation of services may affect the fees incurred and the progress of your case.
- Before Service Commencement: If a client decides to cancel services before any work has been initiated, we will not charge for the services unless any non-refundable retainer or administrative fees have been paid.
- After Service Commencement: If services have already been initiated, clients will be responsible for paying for the work completed up until the cancellation request. This includes any advice, correspondence, or documentation provided.
3. Refund Policy
Refunds for legal services are provided under the following circumstances:
- No Refund for Services Rendered: Once legal services have been provided, no refunds will be issued for fees related to the work already completed. This includes consultations, document preparation, and legal representation.
- Advance Payments and Retainers: If an advance payment or retainer has been made for services that were not rendered or if the client terminates the agreement before work is performed, a refund may be issued for any unutilized amount, after deducting any administrative costs.
- Refund Procedure: Refund requests must be submitted in writing, outlining the reasons for cancellation and specifying any unutilized services. The refund will be processed and credited within a reasonable time frame, typically 7-14 business days.
4. Dispute Resolution
In the event of any disputes regarding the cancellation or refund of legal services, both parties agree to attempt to resolve the matter amicably. If a resolution cannot be reached, the matter may be subject to arbitration or mediation as per applicable laws, or as guided by the ethical standards of the Advocate Act.
5. Non-Refundable Charges
Certain charges, including but not limited to court filing fees, government fees, or third-party expenses, are non-refundable. These costs are directly associated with the legal process and may not be reimbursed once paid.
6. Modifications to Services
If a client requests changes or modifications to the legal services provided, we will evaluate the request and may adjust the fees accordingly. Clients will be informed of any additional costs associated with the changes.
7. Client Responsibilities
Clients are expected to communicate their cancellation requests in a timely manner. Any fees that are due up to the point of cancellation must be paid in full.
8. Compliance with the Advocate Act
Our Refund & Cancellation Policy complies with the ethical guidelines and standards set by the Advocate Act. We prioritize professionalism, transparency, and client satisfaction in all our engagements. We ensure that all practices align with legal and ethical requirements in providing legal services.
